Marijuana Crimes in Florida
Authorities around the country have come to accept that cannabis purchase, sale, possession, and use should be legalized for both medicinal and recreational purposes. Unfortunately, marijuana is still treated as an illegal controlled substance federally and in several states, including Florida. Moreover, Florida maintains extremely harsh penalties for marijuana possession and distribution.
In Florida, possession of 20 grams of marijuana or less is chargeable as a misdemeanor, punishable by up to $1,000 in fines and a year in jail. Distribution without remuneration of 20 grams or less is treated the same. Possession or sale of between 20 grams and 25 pounds is a felony, punishable by up to $5,000 in fines and up to five years in prison. Possession or sale of greater quantities can land a defendant in prison for decades. Possession or sale of hashish or concentrates, even at low quantities, is punishable as a felony.
The landscape of cannabis legality at the state and federal levels is rapidly changing. There may be an initiative to legalize adult use of marijuana on the 2024 ballots in Florida, if industry advocates have their say. Congress and the President might push for federal legalization in the near future as well. If you are facing marijuana possession or trafficking charges, speak with a knowledgeable West Palm Beach cannabis crime defense attorney.
